These Terms and Conditions set out the basis on which Waste Clearance Belsize Park provides waste clearance and related services. By making a booking or allowing our operatives to commence work, you agree that you have read, understood and accepted these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Service means any waste clearance, waste collection, rubbish removal, bulky item removal, recycling, loading, transportation and related services that we provide.
1.2 We, us, our means Waste Clearance Belsize Park.
1.3 You, your means the customer requesting the Service, including any person acting on the customer’s behalf.
1.4 Site means the premises or location where the Service is to be provided.
1.5 Waste means items, materials, rubbish or goods that you request us to remove and dispose of or recycle.
1.6 Agreement means the contract between you and us for the provision of the Service, incorporating these Terms and Conditions and any written or verbal quotation we provide.
2.1 We provide waste clearance and waste collection services primarily for domestic and commercial customers. Services may include removal of general household waste, garden waste, office waste, light construction waste and bulky items, subject to these Terms and Conditions.
2.2 The Service does not include the removal of hazardous, dangerous or specialist waste unless this has been expressly agreed in writing in advance and any applicable surcharges have been accepted and paid.
2.3 We reserve the right to refuse to remove any Waste that we reasonably believe is hazardous, illegal to transport or dispose of, incorrectly described, or in our opinion presents a health and safety risk to our staff, contractors, the public or the environment.
2.4 We will make reasonable efforts to carry out segregation and recycling of Waste where facilities are available, but we do not guarantee a specific recycling or recovery rate for individual collections.
3.1 You may request a Service by telephone, email or other communication methods that we make available from time to time. Bookings are subject to availability and are not confirmed until we issue a booking confirmation.
3.2 When requesting a booking, you must provide accurate and complete information, including:
(a) the address where the Service is to be carried out,
(b) contact details for access on the day,
(c) a clear description of the type and approximate volume or weight of Waste, including any bulky or difficult items,
(d) any access restrictions or parking limitations at or near the Site.
3.3 Any quotation we give based on your description of the Waste and access conditions is an estimate only. The final price will be confirmed by our team upon arrival and inspection of the Waste and Site conditions before work starts.
3.4 If the actual volume, weight or nature of the Waste, or the access conditions, differ materially from the information you provided, we may adjust the price, amend the Service or refuse to carry out the work. In such cases, a call-out or cancellation fee may apply in accordance with these Terms and Conditions.
3.5 By confirming a booking, you warrant that you are the owner of the Waste or have the authority of the owner to arrange its removal and to enter into this Agreement with us.
4.1 You are responsible for ensuring safe, suitable and lawful access to the Site for our vehicle and operatives on the agreed date and time.
4.2 You must inform us in advance of any access restrictions, height or weight limits, loading bays, controlled parking zones or other conditions that may affect our ability to carry out the Service.
4.3 You are responsible for arranging and paying for any required parking permits or authorisations for our vehicle. If adequate parking is not available, we may, at our discretion, either:
(a) reschedule the Service and charge a missed visit fee, or
(b) carry out the Service from a more distant parking location and charge a reasonable additional fee for any extra time and labour incurred.
4.4 If we are unable to gain access to the Site at the agreed time due to circumstances within your control, we may charge a wasted journey or late cancellation fee as set out in these Terms and Conditions.
5.1 You must ensure that the Waste to be collected is clearly identified and accessible to our operatives. You must remove or clearly separate any items that are not to be taken.
5.2 You must ensure that the Site is safe and that any relevant health and safety information is provided to our operatives on arrival.
5.3 You must not request us to remove items that you do not have the right to dispose of, including items belonging to third parties without their consent.
5.4 You agree not to include in the Waste any items that are prohibited under these Terms and Conditions or under applicable waste regulations.
6.1 Our charges are generally based on the type and volume of Waste, as well as labour time, access conditions and disposal costs. We will provide an estimated price at the time of booking, subject to confirmation on arrival.
6.2 All prices are quoted in pounds sterling and, unless expressly stated otherwise, are inclusive of standard rate VAT where applicable.
6.3 We will confirm the final price before commencing the Service, following an inspection of the Waste and Site. If you do not agree to the final price, you may decline the Service, in which case a call-out fee may be charged to cover our attendance.
6.4 Payment is due in full on completion of the Service unless agreed otherwise in writing in advance. We may require payment before unloading or departure from the Site.
6.5 We accept payment by cash, debit card, credit card or other payment methods we may specify from time to time. Where account facilities have been agreed for commercial customers, invoices are payable within the agreed credit terms.
6.6 If you fail to make any payment on the due date, we may charge interest on any overdue amount at the statutory rate, and you will be responsible for any reasonable costs incurred by us in recovering payment, including debt collection and legal fees.
7.1 You may cancel or amend a booking by contacting us as soon as possible. Your right to cancel is subject to the time remaining before the scheduled Service and any costs already incurred by us.
7.2 If you cancel more than 24 hours before the scheduled arrival time, no cancellation fee will normally be charged.
7.3 If you cancel within 24 hours of the scheduled arrival time, we may charge a reasonable cancellation fee to cover our administrative and scheduling costs.
7.4 If our team arrives at the Site at the agreed time and we are unable to carry out the Service due to circumstances within your control, including but not limited to lack of access, absence of an authorised person on Site, or refusal to accept the confirmed price, we may charge a wasted journey fee.
7.5 We reserve the right to cancel or reschedule the Service if we are unable to attend due to circumstances beyond our reasonable control, such as vehicle breakdown, severe weather, accidents, road closures or staff illness. In such cases, we will offer you the next available appointment, but we shall not be liable for any resulting loss or inconvenience.
8.1 We will not knowingly collect or transport hazardous waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuel, pressurised containers, explosives, radioactive materials, or any other substances classified as hazardous under applicable regulations, unless specifically agreed beforehand.
8.2 We may refuse to remove any items that we reasonably consider unsafe to handle, excessively heavy without appropriate equipment, or likely to damage property or our vehicle.
8.3 If hazardous or prohibited items are discovered within the Waste after collection, you may be liable for any additional costs, fines or expenses incurred by us in handling, storing or disposing of such items safely and lawfully.
9.1 We will transport and dispose of Waste using appropriately licensed facilities and in accordance with applicable waste management and environmental legislation.
9.2 We will, upon request and where required, provide confirmation that we hold the necessary registrations or licences for waste carriage.
9.3 You acknowledge your duty of care under waste legislation to ensure that Waste is transferred only to an authorised person and is accurately described. By instructing us, you confirm that all information you provide regarding the nature of the Waste is complete and correct.
9.4 Once the Waste has been loaded onto our vehicle and payment has been received, ownership of the Waste transfers to us and you will have no further rights or responsibility for it, except in cases where you have misdescribed the Waste or concealed prohibited items.
10.1 Our operatives will take reasonable care when carrying out the Service. However, waste clearance often involves the movement of bulky or awkward items through confined spaces, which carries an inherent risk of minor damage.
10.2 You must inform our operatives of any fragile areas, surfaces or fixtures at the Site that require particular care.
10.3 We shall not be liable for:
(a) any pre-existing damage to the property or contents,
(b) minor scuffs, marks or damage reasonably incidental to the careful performance of the Service where access is restricted,
(c) damage arising from defects in the property, such as weak flooring, stairs, walls or fixtures.
10.4 Any damage or loss that you believe has been caused by us must be reported to us in writing as soon as reasonably practicable and in any event within 7 days of the Service. We may inspect the alleged damage before accepting any responsibility.
11.1 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
11.2 Subject to clause 11.1, our total liability in respect of any claim arising under or in connection with the Agreement, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total price paid or payable by you for the specific Service to which the claim relates.
11.3 We shall not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity, loss of data or loss of reputation, whether foreseeable or not, arising out of the performance or non-performance of the Service.
11.4 We shall not be liable for any delays or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, industrial disputes, accidents, road closures or public transport disruptions.
12.1 We maintain public liability insurance and other policies as we consider appropriate for the provision of waste clearance services.
12.2 Our insurance cover is subject to the terms, conditions and exclusions of the relevant policies. You are responsible for arranging any additional insurance you deem necessary for your property or contents.
13.1 If you are dissatisfied with any aspect of our Service, you should raise your concern with our operatives on the day if possible, so that we have an opportunity to address the issue immediately.
13.2 If the matter is not resolved on Site, you should submit a written complaint to us as soon as reasonably practicable, providing your name, contact details, the date and address of the Service, and a clear description of the issue.
13.3 We will investigate your complaint and aim to respond within a reasonable time. We may request further information or evidence before reaching a decision.
14.1 We collect and process personal information necessary to manage bookings, provide the Service, process payments and handle enquiries or complaints.
14.2 We will take reasonable steps to safeguard your personal information and will not sell or share it with third parties except where necessary to deliver the Service, recover payments, comply with legal obligations or where you have given your consent.
15.1 We may revise these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date of publication.
15.2 The version of the Terms and Conditions that applies to your booking is the version in force at the time the Agreement is formed.
16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of England and Wales.
16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
17.3 You may not assign or transfer any of your rights or obligations under the Agreement without our prior written consent. We may assign or subcontract our rights and obligations as we reasonably consider appropriate, provided that this does not materially affect the Service.
17.4 These Terms and Conditions, together with any quotation or confirmation of booking, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings or arrangements, whether oral or written.
